BRIBERY ACT NEEDN’T AFFECT RELATIONSHIPS WITH PULSE UMBRELLA

The Bribery Act is a cause of serious consternation for many UK businesses and employers and despite it being put on hold from its proposed April start date, it is currently under review and expected to be passed in the not so distant future.

The Act is being introduced as part of a wider scheme by the government to make the UK economy more transparent, including HMRC’s battle against tax avoidance, which means all small and medium-sized enterprises will come under unprecedented scrutiny until the Act gets the green light.

Although final guidance on the law is yet to be published, lawyers say SMEs should already be taking steps towards compliance, as prosecutors will argue that they have had “ample time” to prepare.

The Act will state that bribing, receiving a bribe and, most problematically, failing to prevent bribery, are all offences – wherever they take place – for a UK firm with outside connections.

All employees, directors and even joint venture partners are likely to be considered “associated” with a company if they carry out activities on behalf of that company.
