The Sins of SAC Capital’s Steven Cohen at Tech2Trade Expo 2013’s HFT Conference in New York City

New York City, NY, USA (July 22, 2013) — According to The Wall Street Journal, the Securities and Exchange Commission (SEC) recently filed a civil-enforcement action against SAC Capital Advisors LP chief Steven A. Cohen, alleging he ignored “red flags” that should have alerted him to insider trading “under his watch.” The SEC said Mr. Cohen “failed to take reasonable steps to investigate and prevent” insider trading at the Stamford, Conn., hedge-fund firm.

The move is the first time regulators in the investigation have brought an action against Mr. Cohen personally. His firm, one of the most successful on Wall Street over the past two decades, has in recent years been the subject of a long-running investigation into insider-trading that has resulted in criminal charges against a number of traders and others with ties to SAC. But, while trading involving Mr. Cohen has been cited in government documents related to those cases, he hasn’t been criminally charged in those matters or any other.

According to the SEC’s order, Mr. Martoma and Mr. Steinberg obtained material nonpublic information about publicly traded companies in 2008, and they traded on that information. The government charged Mr. Martoma with insider trading last year and charged Mr. Steinberg earlier this year. Messrs. Martoma and Steinberg have pleaded not guilty. Mr. Steinberg’s lawyer has said he did nothing wrong. Mr. Martoma’s lawyer has said the case against him is based on innuendo. The SEC alleges Mr. Cohen ignored “highly suspicious information” that should have prompted “any reasonable hedge fund manager” to investigate.

Prior to joining the SEC, Cohen was in private practice and served as a law clerk to the Honorable Alexander Williams, Jr., United States District Court for the District of Maryland. He received his J.D. from New York University School of Law, where he served on the Law Review, and received a B.S. from Cornell University.

New York City, NY, USA (July 22, 2013) — According to Robert Anglos, HFT is still around, but is being done by fewer people. “There is, no doubt, numerous reasons but my take, as a HF trader, is that a lot of people that got in was when the markets were tanking and it was being touted as a ‘get rich quick’ approach to making money. When the reality set in most went away, just like small investors that lost a lot of money either did not come back or not as strong.”

Anglos is an HFT and admits there is some misconception of what most HFT do and where. “Generally we, and almost never for me, are we trading stock. We do not, and are not capable of moving the markets. We do have the ability to exploit and perhaps extend a movement when the markets are highly sensitive (probably the basis for the argument that HF traders help them get where they are going quicker).”

Trading is not investing, he said. “In many respects investing, in my view, is the equivalent of hope or taking advantage of a situation. In the old days you could buy AT&T, or its equivalent, and believe that it was going to appreciate until the end of time (and pay dividends). Keep this in mind only 1 in 100 people that try day trading make a living at it. Some make excellent money, but I wonder how many investment professionals that are at the same in their profession make at least as much. I have no statistics but I believe any of the senior execs at Goldman Sachs, J.P. Morgan are making far more.”

How High Is High-Frequency Trading at Tech2Trade Expo 2013 New York City, World Financial Center

New York City, NY, USA (July 12, 2013) — PBS News Hour just reviewed high-frequency trading, which represents more than half of all transactions of American stocks these days; but just how fast is high-frequency? So fast, it turns out, that data companies now provide financial data to their most premium subscribers early — as little as two milliseconds early in the case of a $20,000-per-month service the Nasdaq and Chicago Mercantile Exchange debuted in May using microwave networks. That time difference is enough to gain quite the financial advantage.

One key data provider, Thomson Reuters, announced this week it was suspending its 9:54:58 a.m. release of the University of Michigan’s consumer confidence data to about a dozen premium subscribers (not to be confused with those regular money management customers who pay to receive the data at 9:55 a.m., a measly five minutes before the University of Michigan posts the consumer confidence index online) while New York Attorney General Eric Schneiderman investigates the practice.

Thomson Reuters maintains that their 9:54:58 a.m. release, for which some clients pay more than $6,000 a month, does not violate federal insider trading laws since they disclose the tiered pricing to all customers.

All this without truly investing in a productive asset – a company that might make a difference to wider society. Any integrity markets might have once had now lies in tatters.

At this precise moment, the world of HFT is analogous to a frontier town. Only this time, it is not humans displaying wild west-style behavior but the machines we have created. The flash crash of 2010 was a wake-up call. However, it seems the regulators are still asleep and we all know where that leads – circa the 2008 global economic crisis we are still coming to terms with today. Perhaps, carrier pigeons were not such a bad idea after all.

In Search of Liquidity at Tech2Trade 2013, World’s Most Influential High-frequency Trading Conference

New York City, NY, USA (June 25, 2013) — A deeply liquid market is considered a sign of a healthy market with lots of participants, but Commissioner Bart Chilton, Commodity Futures Trading Commission, says all liquidity may not be the same and could be distorting markets. The CFTC is concerned that some of the liquidity that may be provided by high-frequency traders could be “fantasy liquidity created by ‘wash’ sales,” which is prohibited under both the Commodity Exchange Act and exchange rules.

High-frequency traders enter and exit the market quickly and can do so multiple times a day, helping to create a more liquid market. But they’re a relatively new addition to the trading world and Chilton said how they operate needs closer scrutiny, especially since at times they can be 30% to 50% of a market. The concern is over “wash” trades, which happens a trader trades with himself, in other words puts out a bid price and matches it. “If you’re trading with yourself, you have nothing to lose, you’re not taking a risk. If this was occurring a little bit, it would be no harm, no foul,” Chilton said.

However, he said, this is happening more than a little bit, calling the wash trades “voluminous.” Chilton said there may be two reasons why these wash trades are happening. One is to make it look like there is deep volume to entice other people to trade those markets. Second, these traders may be part of legitimate market-maker programs, which is when an exchange pays a market-maker to provide liquidity. “But it’s dangerous if you’re trading with yourself and taking no risk. It can also affect price discovery and hurts consumers,” he said.

Mr. Perez attributed the recent Dow Jones Industrial Average’s (DJIA) longest winning streak since 1996 to very good corporate earnings and monetary policy that pushes investors to take risks in equities. So he asked himself if the earnings momentum is sustainable. “Unfortunately, savings from the smaller share of the pie from labor, government spending and earnings coming from emerging markets (EM) outside the US are all factors that will be curtailed at some moment. Is the Fed eager to continue being the huge player in this equation? Some of its members are increasingly worried about the effectiveness of the continued QE; if the labor market recovers, as the January numbers showed, the Fed most probably might be ending its bond purchases soon.”

“What the equity markets want indeed is stable and/or predictably increasing US profits and the Fed to stay in the bond markets. Somebody has ironically suggested that markets’ best hope might be a cut in government spending deep enough to kill job growth and indefinitely extend QE, something that nobody else would agree with. Instead, markets would be happy with a bit of positive news today followed by another bit of negative news tomorrow. Unfortunately for the markets, profits will start showing stagnation starting with first quarter results. Federal Reserve said in September 2012, when QE3 was announced, that it would start pumping $40 billion a month to purchase agency mortgage-backed securities (MBS) until the labor market improves substantially. When will the Fed determine that the job market has made enough progress to reduce stimulus? The numbers for February will prove paramount in this regard. As these two important factors converge in a nightmarish scenario, equities markets should beware of the ensuing correction, coming as early as in the second quarter.”
