DHS, FBI and DOJ Data Hacks Could Have Been Avoided, says Cybersecurity Expert and Consultant Edgar Perez

New York City, NY, USA (February 13, 2016) — The recent hacker attack that compromised information from some 20,000 people employed by the Department of Justice, including Federal Bureau of Investigation officials, and another 9,000 from the Department of Homeland Security (DHS) could have been prevented, said Edgar Perez, author of Knightmare on Wall Street and The Speed Traders, and presenter of the 3-Day Masterclass in Cybersecurity.

According to technology news site Motherboard, the hacker had used spear phishing and simple human engineering to bypass one stage of the authorities’ security systems. Motherboard quoted the hacker, who explained: “So I called up, told them I was new and I didn’t understand how to get past [the portal]. They asked if I had a token code, I said no, they said that’s fine – just use our one.”

Mr. Perez, author, business consultant for private equity and hedge funds and Council Member at the Gerson Lehrman Group, took issue with the relatively ease with which hackers gained access to the organizations in charge of protecting the security of millions of Americans. “It is beyond my understanding how personnel of the Department of Homeland Security didn’t take steps to verify an anonymous request from an alleged new employee. Furthermore, they provided the pseudo employee with a token code no questions asked. What this reveals is a dramatic lack of awareness of the very cyber risks the agency is tasked with fighting against.”

This recent incident comes after a June data theft from the Office of Personnel Management (OPM) that exposed the deeply researched security clearances of 21.5m current and former government employees and contractors, from phone numbers to fingerprints.

Ten Questions by Edgar Perez about Navinder Singh Sarao, the Man who Allegedly Caused the Flash Crash

New York City, NY, USA (April 23, 2015) — The U.S. Commodity Futures Trading Commission (CFTC) yesterday announced the unsealing of a civil enforcement action against UK resident Navinder Singh Sarao. The CFTC complaint charges Sarao with “unlawfully manipulating, attempting to manipulate, and spoofing” the E-mini S&P 500. The complaint had been filed under seal on April 17, 2015 and kept sealed until yesterday’s arrest of Sarao by British authorities acting at the request of the U.S. Department of Justice.

According to the complaint, Sarao’s “manipulative activities” contributed to an extreme E-mini S&P order book imbalance that contributed to market conditions that led to the Flash Crash on May 6, 2010. The surprising nature of this announcement raises more questions than answers:

• Shall we believe that a single low-tech trader living in a leafy street of a London suburb contributed in any significant way to the Flash Crash?
• Why would the authorities rush to charge Sarao for the biggest financial markets breakdown just before the statute of limitations is expiring?
• Why would professional traders fall for the rudimentary and well-known strategies employed by this individual and let him pocket millions?
• Would this trader be the only market participant who engaged in this type of strategies during the “relevant period”?
• Why is the U.S. Securities and Exchange Commission not joining the CFTC in this action after authoring a joint report about the Flash Crash?
• Was Waddell & Reed behind the unnamed whistleblower in an effort to clean its name and enhance its reputation?
• Why did regulators have to rely on a whistleblower to build the case having had the opportunity to pinpoint this behavior five years ago?

Are we going to let people throw around billion dollar orders with no understanding of market impact?”

If nothing else, the Knight Capital trading glitch underscores the complexity of today’s capital markets, which have become increasingly dominated by complicated trading algorithms. “Consumers don’t understand markets any longer so they increasingly distrust our stock markets and are withdrawing,” David Weild, a senior advisor at Grant Thornton and former vice chairman at the Nasdaq Stock Market, wrote. “Deregulation stimulated competition but in extremis: The computer arms race that ensued, enabled by the SEC, has introduced a level of complexity and behaviors that is undermining investor confidence.”

Newly Appointed Executive Markets Director, AMF, at World’s Most influential London HFT Conference

New York City, NY, USA (March 12, 2013) — Philippe Guillot the newly appointed Executive Director of the Markets Directorate, Autorité des Marchés Financiers, will be speaker at upcoming, Golden Networking‘s High Frequency Trading Leaders Forum 2013 London, “Strategic and Tactical Insights for Investors, Speed Traders, Brokers and Exchanges”, March 21. The Markets Directorate is a new entity formed in 2011 to monitor the markets, infrastructures and market stakeholders. With a headcount of around 40, it reports to the Asset Management and Markets Directorate, run by Arnaud Oseredczuk. The AMF Markets Division monitors financial markets, infrastructures and market stakeholders.

According to Waters Technology’s Steve Dew-Jones, regulators are giving Mifid I-which increased competition-a vote of confidence, but are also highlighting the increased complexity and unintended consequences that followed the legislation. In this regard, Guillot says that “market microstructure is incredibly fragile and we do not know exactly what will happen when we change it.”

Mr. Guillot added: “If you take the minimum resting time proposition, this is something that is very harsh and there is no way back after you have done it because if you put it at 500 milliseconds, afterward it will be very difficult to say, ‘Oh, maybe we should have put it at 480 or 520.’ Look at what happened in Mifid I. If you decide to create competition, it’s very difficult to come back, and you have lots of unintended consequences.”

Mr. Guillot began his career in finance in 1987 at DKL James Capel (now HSBC), where he held various positions focused on financial markets. In 1991 he joined Enskilda Securities as a market maker, first in Paris then in London. In 1998 he moved to Crédit Agricole Cheuvreux in Paris, taking over as head of Facilitation, before being appointed Group Trading Director in 2006, in Paris then London.

Throughout all these years, Mr. Guillot has played an active role in numerous working groups and market authorities dealing with MiFID issues. He was a member of the Securities Trading Committee of the AFME (Association for Financial Markets in Europe), and represented Cheuvreux with the Regulated Markets and MTF (Multilateral Trading Facilities). Mr. Guillot holds a degree in private law from Paris XI University.

The AMF was established by the Financial Security Act of August 1st 2003, and was formed from the merger of the Commission des Opérations de Bourse (COB), the Conseil des Marchés Financiers (CMF) and the Conseil de Discipline de la Gestion Financière (CDGF). The objective in amalgamating these bodies was to improve the efficiency of France’s financial regulatory system and to give it greater visibility. The AMF also lends its support to financial market regulation at the European and International levels.

Mark Cuban Invited to Meet High-Frequency Trading Mavericks at Chicago Shark Tank, October 9

It’s not impossible to know that our economy has suffered because Wall Street equity markets are no longer a source of equity for helping companies grow, it is not a platform for hackers and that needs to change.
