Global Lender Equities First Holdings Sees A Growing Trend Among Borrowers Who Use Stock as Loan Collateral to Secure Working Capital

As Banks and Financial Institutions Tighten Lending Criteria, Stock-Based Loans May Offer Some Investors an Attractive Alternative to Raise Capital.

Indianapolis, IN, USA — Equities First Holdings, LLC (EFH, http://www.equitiesfirst.com), a global lender and a leader in alternative shareholder financing solutions, is seeing more traction in margin loans and stock-based loans in an economic climate where banks and other institutions have tightened lending criteria. For borrowers who need to raise capital quickly or who may not qualify for more conventional credit-based loans, equities lending is gaining popularity as an alternative.

While some options still exist for these individuals, recently, many banks have cut their lending options for borrowers, tightened loan qualifications, and increased interest rates. Al Christy, Jr., Founder and CEO of EFH, sees loans collateralized by stocks as an innovative borrowing alternative for individuals seeking working capital. Stock-based loans typically have a higher loan-to-value ratio than margin loans and offer a fixed interest rate, providing certainty throughout the life of the transaction.

“During a typical three-year loan term, market fluctuation is inevitable, but stock-based loans provide a hedge because the borrower is lowering his or her investment risk in a downside market,” said Christy. “Most stock-based loans have a non-recourse feature that allows a borrower to walk away from a stock loan at any point, even if the stock’s value depreciates. The borrower is able to keep the initial loan proceeds with no further obligation to the lender.”

As Christy notes, some consider margin loans and stock-based loans to be synonymous. Although both forms of financing use securities for collateral, there are marked differences.

With a margin loan, the borrower must be pre-qualified, as with a conventional bank loan, and may require the money to be used for a specific purpose. The interest rates are variable and the borrower can expect loan-to-value ratios between 10 and 50 percent. In addition, the lending firm may liquidate the borrower’s collateral without warning in the event of a margin call.

With stock-based loans, borrowers can expect a fixed interest rate between three and four percent and a loan-to-value ratios ranging from 50 to 75 percent. There also are no restrictions on the loan, so the money can be used for any purpose. In addition, most stock-based loans are non-recourse, so borrowers can walk away without obligation, even if the value of the collateral stock has decreased.

“Any form of financial transaction has some risk associated with it,” said Christy, “But stock-based loans have been historically ignored as a viable borrowing option largely because a number of unscrupulous lenders have unceremoniously dumped borrowers’ collateral into the open market, failed to return stocks upon transaction maturity, or failed to address other concerns. We have built our business on a code of integrity and transparency and we rely on leading legal, regulatory, and trading institutions for counsel. Our mission is to deliver maximum benefit with minimum risk so our customers can meet their personal and professional financial goals.”

Australian House Prices Soar Due to Negative Gearing!!!

So called experts get it wrong again – By Gary Lanyon

Victoria, Australia, June 4th, 2016 — There are many theories as to why Australian housing prices have soared over the past decade, most of these so called experts look to peripheral factors with flimsy evidence to back up their claims.

Negative gearing is one of their pet factors they claim has caused residential housing prices to soar however, this has been government policy for over 25 years and their claims are flawed as I will explain later in this article. Negative gearing was originally designed to increase the rental housing supply and figures indicate that the policy is an outstanding success for both tenants and investors. Investment housing as indicated below in graph 1 now matches home owners in value and thus any disruption to this policy will cause a major downturn in the Australian housing market.

Graph 1 - Owner vs Investment Housing Loans

The obvious cause of soaring housing prices is the collapse in interest rates over the past 8 years, falling by as much as 6%, from 7.75% in 2008 to 1.75% in March 2016 as indicated in graph 2. The collapse in interest rates allows home buyers to borrow more against their current homes or investment property thus increasing the value of the housing stock. This spiral upwards is to the despair of first home buyers who struggle to catch up with the ever increasing values. Retirees also suffer as bank interest is no longer an option for retirement income.

The Australian Labour Party (ALP) have seized on a flawed report on Negative Gearing by The Grattan Institute to push their cause. The Grattan Institute fails to address interest rates as the main case of the property boom and naively suggests investors should buy new homes on the fringe of suburbia where capital growth is lowest and any resales compete directly with the cost of construction rather than demand.

Furthermore, the ALP policy would also reduce the number of buyers in the property market by around a third with the property sector being split equally in three areas, Tenants, Investors and Home Owners. This naive policy to change the current negative gearing policy is at the peril of most Australians as the stampede to sell early will have catastrophic consequences on the Australian economy and unemployment, with a third of all property purchasers vacating the property market to look for more lucrative investments and Tenants finding accommodation almost impossible to secure.

Graph 2 - Australian Cash Rate

Also, had The Grattan Institute simply looked across the ditch, they would find that the New Zealand taxation system doesn’t have a Capital Gain Tax at all and personal taxation rates are significantly lower than Australia’s being 10.5% = $0 to $14,000; 17.5% = $14,001 to $48,000; 30% = $48,001 to $70,000 and 33% thereafter. Other countries in our region (Singapore 17%, Hong Kong 16.5%) similarly have significantly lower taxation rates than Australia’s.

Finally, The Grattan Institute article seems to be a naïve attempt to increase taxation on flimsy evidence where in contrast, the majority of evidence is that Australia’s taxation system as simply uncompetitive with the rest of the world.

Market Rates Insight TrendSpotter Analysis Reveals Banks Ignoring the Data and Abandoning Potential Fee Revenue

New Analysis Using MRI’s TrendSpotter Report Shows that Reducing Fees Has Little or No Impact on Deposit Growth.

San Anselmo, CA, USA — According to a recent analysis published by CenterState Bank, banks are reducing fees on deposit accounts despite the fact that fees seem to have little or no impact on the current increase in deposit balances. The analysis was developed using TrendSpotter, a new research tool that tracks accumulated fee trends for banks and credit unions nationwide produced by Market Rates Insight, Inc., the leader in financial services pricing intelligence for deposits, personal loans, mortgages, and fees.

According to the TrendSpotter analysis, service charges have been declining for banks of every size over the last quarter – deposit fees averaged $8.42 per month in December and declined to $7.92 the end of first quarter. At the same time, balances required to open accounts have dropped by 15 percent since December, and the average balance to waive fees has dropped 6.6 percent. The decline in deposit fees seems counterintuitive in a market climate where deposit balances are increasing as a result of behavioral economics rather than fee elasticity.

“We have looked at this all different ways and find this borderline irrational. Our only conclusion is that banks are not looking at the data,” wrote Chris Nichols, Chief Technology Officer of CenterState Bank and author of the analysis. “As long as you are not drastic, you can raise fees, lower fees or leave fees the same and you are still going to get more deposits. If you are not, it is a marketing/value problem, not a fee problem.”

As Nichols notes, that fee elasticity is negative in most markets, and even banks that have not lowered fees on deposit products are still increasing deposit balances. Banks that did not raise deposit fees for the quarter saw an increase of 2.3 percent, while banks that did raise fees increased deposits 2.1 percent, indicating that consumers are clearly not fee sensitive.

Nichols’ conclusion is that this is the perfect market climate for banks and credit unions to consider raising fees without risk. Banks that are lowering fees in order to attract new customers and increase deposit balances, and are ignoring the market data and abandoning possible revenue at a time when banks and credit unions are facing near record-low net interest margins.

About TrendSpotter
TrendSpotter is a unique tool that gives bank and credit union executives an understanding of accumulated fee trends in the marketplace. Data is extracted from Market Rates Insight’s FeeBuilder, the first database of retail deposit fees that tracks overdraft, non-sufficient funds, monthly service charges, ATM fees, wire transfer, on checking, money market, savings, certificate of deposit, and more. TrendSpotter extracts trends from the FeeBuilder database and provides a picture of fee pricing and penalties for banking products nationwide. User can overlay their own fee pricing to create a trend line that shows how the competition affects revenue, attrition, and volume for their own fee-based products.

TrendSpotter is issued quarterly on an annual subscription basis. For more information, visit http://www.marketratesinsight.com/news/MRI_TrendSpotter.aspx.

Ten Questions by Edgar Perez about Navinder Singh Sarao, the Man who Allegedly Caused the Flash Crash

Building off of the momentum of past successful workshops, Edgar Perez is bringing Cybersecurity Boardroom Workshop 2015, seminar specifically designed for board members, senior executives and entrepreneurial business professionals looking for new ways to gain and maintain competitive business advantage in one of the most critical subjects for corporations and governments worldwide.

New York City, NY, USA (April 23, 2015) — The U.S. Commodity Futures Trading Commission (CFTC) yesterday announced the unsealing of a civil enforcement action against UK resident Navinder Singh Sarao. The CFTC complaint charges Sarao with “unlawfully manipulating, attempting to manipulate, and spoofing” the E-mini S&P 500. The complaint had been filed under seal on April 17, 2015 and kept sealed until yesterday’s arrest of Sarao by British authorities acting at the request of the U.S. Department of Justice.

According to the complaint, Sarao’s “manipulative activities” contributed to an extreme E-mini S&P order book imbalance that contributed to market conditions that led to the Flash Crash on May 6, 2010. The surprising nature of this announcement raises more questions than answers:

• Shall we believe that a single low-tech trader living in a leafy street of a London suburb contributed in any significant way to the Flash Crash?
• Why would the authorities rush to charge Sarao for the biggest financial markets breakdown just before the statute of limitations is expiring?
• Why would professional traders fall for the rudimentary and well-known strategies employed by this individual and let him pocket millions?
• Would this trader be the only market participant who engaged in this type of strategies during the “relevant period”?
• Why is the U.S. Securities and Exchange Commission not joining the CFTC in this action after authoring a joint report about the Flash Crash?
• Was Waddell & Reed behind the unnamed whistleblower in an effort to clean its name and enhance its reputation?
• Why did regulators have to rely on a whistleblower to build the case having had the opportunity to pinpoint this behavior five years ago?
• Is Waddell & Reed getting ready to sue the CFTC and SEC for hundreds of millions of dollars in lost business and defamation?
• Why would regulators let Sarao operate in the markets and engage in similar trading strategies as in the Flash Crash eight more times?
• Wasn’t one Flash Crash enough to better police the markets and stop Sarao for good?

These ten important questions are raised by Edgar Perez, author of Knightmare on Wall Street and The Speed Traders; in the latter volume, Mr. Perez dedicated an entire chapter to explain the Flash Crash, in the chapter entitled “The Real Story Behind the ‘Flash Crash'”. “Who puts in a $4.1 billion order without a limit price? The trader at Waddell & Reed showed historic incompetence. On May 6, when markets were already under stress, the sell algorithm chosen by the large trader and set to target only trading volume, and neither price nor time, executed the sell program extremely rapidly in just 20 minutes. The execution of this sell program resulted in the largest net change in daily position of any trader in E-Minis since the beginning of the year. This was a human mistake. The trader easily could have put a price limit on the order but recklessly chose not to. The sell algorithm performed exactly as it was designed. Now that the regulators know what happened, what are they going to do? Is there any penalty for massively disrupting the market? Are we going to let people throw around billion dollar orders with no understanding of market impact?”

Mr. Perez is bringing Cybersecurity Boardroom Workshop 2015 to Dubai, Hong Kong, Seoul, Singapore, London and New York City. Members of the board, senior executives and entrepreneurial business professionals of public and private firms looking for new ways to gain and maintain competitive business advantage will congregate in each of these cities for inspiring 2-day sessions these upcoming months of April and May.

Mr. Perez is a published author, business consultant for billion-dollar private equity and hedge funds and Council Member at the Gerson Lehrman Group, with subject matter expertise in cybersecurity, investing, trading, financial regulation (Dodd-Frank Act) and market structure. Mr. Perez has presented his workshops in cities around the world, including Hong Kong, Sao Paulo, Seoul, Kuala Lumpur, Warsaw, Kiev, New York, Singapore, Beijing and Shanghai. He contributes to The New York Times and China’s International Finance News and Sina Finance.

ABOUT CYBERSECURITY BOARDROOM WORKSHOP 2015
Cybersecurity Boardroom Workshop 2015 (http://www.cybersecurityboardroomworkshop.com) is a must-attend forum for board members, CEOs, CFOs, COOs and executive managers who need to become more educated about cyber security in order to ask questions that are strategic yet granular enough to address company specifics. Cybersecurity Boardroom Workshop 2015 is targeted at corporate decision-makers for whom cybersecurity readiness is a relatively new yet critically important area to be intelligently conversant about.

Adobe, ADP, E*Trade, Fidelity, Home Depot, JPMorgan Chase, Nasdaq, Neiman Marcus, Sony, Target and Wal-mart are just a few of the large companies that have suffered high-profile cyber security breaches. Cybersecurity Boardroom Workshop 2015 is specifically designed for boards of directors and senior executives of public and private firms looking for new ways to gain and maintain their competitive advantages. Business executives with responsibility for IT, finance, compliance, risk management and procurement as well as entrepreneurs and innovators are welcome to add their points of view to the debate.

VIVIER MORTGAGES LIMITED “VML” AND LUIGI WEWEGE MEDIA STATEMENT

DUBLIN, IRELAND, February 24, 2015 — /REAL TIME PRESS RELEASE/ — Over the past few months VML was contacted by Mr Conor Ryan and other reporters working on a programme for RTE, the Irish broadcaster.

It soon became clear that a number of untrue and defamatory allegations – about VML and persons formerly or currently connected with it – would be made in the programme and had already been made to third parties. After VML clearly outlined the correct position to RTE, its lawyers confirmed that the programme and/or its reporting would be “fair and balanced”, “fair, impartial and objective”, “fair to all interests concerned”, “fair and accurate”, “broadcast in good faith” and contain “nothing misleading, unsavoury or malicious” nor any “distortions or untruths”. VML was further assured by RTE’s lawyers that it “adheres to high standards of journalistic ethics” and follows “proper journalistic standards”.

Unfortunately, this did not happen: despite withdrawing many of the untrue and defamatory allegations, when broadcasting its programme on 5th February, RTE retained a number of others.

Accordingly, on 13th February 2015, following the advice of Senior and Junior Counsel, VML issued proceedings against RTE and Mr Ryan. The proceedings are for defamation, procuring a breach of confidence, malicious falsehood and other wrongs, for which aggravated and exemplary damages are sought. It is expected that other parties will issue similar proceedings in the English High Court.

The true position, as previously stated to but ignored by RTE, is as follows:
• In 2004, VML effectively came under the control of the British Government.
• In 2011, VML was sold by the British Government to an English private company.
• In 2014, VML was sold by that English company to its present owner.
• The beneficial owners of VML’s shares and debt are those appearing on the public register.
• VML’s current owner and directors are entirely distinct from the previous owners and directors.
