Beware Of Loan Modification Companies And Loan Modification Companies Beware!!

Vulnerable mortgage and credit card debtors are prey to the ruthless individuals working under the pretense of companies with seemingly reputable and venerable names that engage in illegal and sometimes fraudulent loan modification services or, in some cases, NO SERVICES AT ALL. Many of these companies have defrauded such debtors out of THOUSANDS OF DOLLARS without obtaining any results whatsoever for the debtor, perhaps because no services were performed at all or such companies knew that there would be no modification to the loan but yet charged and accepted fees anyway from the debtor in advance.

For the past few months, the Attorney General of New Jersey filed lawsuits and imposed fines against several companies and individuals that were engaged in violations of these laws and other laws. The counts in the complaints ranged from violations of the Debt Adjuster Act (also known as the Debt Adjustment and Credit Counseling Act) to the Consumer Fraud Act. Search Milgram v. United Credit; Milgram v. Hope Now Financial Services and Milgram v. New Hope Modifications. Loan modification services in exchange for fees is ILLEGAL unless it is done by an attorney or a qualifying non-profit organization. See NJ Stat. Sec. 17:16G-1, et seq. Under this law, known as the Debt Adjuster Act, a “debt adjuster” is defined as any person who “acts or offers to act for a consideration as an intermediary between a debtor and his creditors for the purpose of settling, compounding, or otherwise altering the terms of payment of any debts of the debtor.”

Bogus loan modification companies are charging exorbitant illegal fees ranging from $2,000 to over $3,500 because such companies are not attorneys. If debt adjuster work is done by a qualifying non-profit, then the fees are limited to a maximum $60 per month to a non-profit credit counselor per consumer. See NJ Admin. Code Sec. 3:25-1.2. Also, any non-profit company must have a license and a $50,000 bond to be permitted to perform debt adjustment services.
Loan modification is simply an area involving the practice of law; it’s contract negotiation with a lender, which is why lawyers are permitted to charge their normal (but hopefully reasonable) legal fees for such services. See NJ Stat. Sec. 17:16G-1(c)(2)(a), which explicitly carves out an exception to the law known as the NJ Debt Adjuster Act. A violation of the NJ Debt Adjuster Act is a fourth degree offense and the fines start at $1,000 for first offense and then $5,000 for each subsequent offense. NJ Stat. Sec. 17:16G-8.

Therefore, CALL AN ATTORNEY before you give any money to any non-attorney that offers to modify your loan for a fee. But, for those of you non-attorneys who are engaged in loan modification work, STOP IT NOW, lest you violate the Debt Adjuster Act.

Lock up your goods to stop thieves this winter

Displaysense – the leading retail display and shop fittings supplier – is advising its retail customers to keep valuable goods under lock and key after reports of increasing numbers of thefts and a surge in purchases of lockable display cabinets.

“With the recession still showing a strain on society, thieves are grabbing the opportunity in this festive period to sell stolen goods to people looking for a bargain and retailers want to avoid being easy pickings for these shoplifters.”

Retailers who are concerned that introducing lockable cabinets may detract from the appearance of their store need not worry, as Displaysense offers a wide range of products designed with both security and aesthetics in mind.

Meanwhile, anyone who is worried that customers will be put off by being unable to touch the products on display will find that their fears are unfounded.

Estate Planning To Avoid New Jersey Death Taxes

New Jersey remains one of the most oppressive taxing states in the U.S. We must remain vigilant to uncover all possible legitimate tax savings strategies. In addition to the taxes you pay during your life, you may have to pay taxes when you die, unless you plan carefully to avoid them.

New Jersey has two types of death taxes (taxes to pay on your assets when you die): inheritance tax and estate tax. Both taxes have maximum tax rates up to 16%. Because most people leave their assets to their spouse, children, and grandchildren, their estates are exempt from the inheritance tax. This exemption also applies to bequests to parents, grandparents, or a charity.

The estate tax, on the other hand, only provides an exemption in a dollar amount of $675,000 for all estates with a deduction for bequests going to the spouse or a charity. So estates that have a value of $675,000 or less will not be taxed regardless of the beneficiary. But, after deducting bequests to the spouse and charities, there will be an estate tax unless the estate is $675,000 or less. The bad news about the estate tax is that bequests to children or grandchildren are not afforded an exemption or deduction.

The good news is that with the proper estate plan implemented through my law office, it’s possible to save your family up to $33,200 on an estate of $1 million, or up to $284,000 on an estate of $10 million (depending on the assets and beneficiaries of the estate). The chart above shows the estate tax and possible tax savings for certain applicable estate plans.

The most recent proposal may increase the federal estate tax exemption to $5 million per person. If such an increase is enacted, we should obviously plan to save federal estate taxes as well when assets and life insurance exceed $5 million. This article, however, only covers the NJ estate tax.

You must plan carefully in order to maximize these tax savings. A will and a trust may be absolutely necessary to achieve these amounts of tax savings. Also, a careful review of your assets and life insurance is required because life insurance may require special planning considerations and techniques.
